Language Precedence: This Privacy Policy is originally drafted in Japanese and may be translated into English or other languages for convenience. In the event of any conflict, discrepancy, or inconsistency between the Japanese language version and any translation thereof, the Japanese language version shall prevail and govern in all respects.

  • The term “Landlord” means any user who is a landlord, property manager, owner, or sub-lessor who lists a property for rent on the Website.

  • The term “Tenant” means any user who searches, applies, contacts, or reviews properties for rent on the Website.

Updates to our Privacy Policy: We may revise this Privacy Policy from time to time at our sole discretion to reflect changes in our business operations, technological changes, or legal updates in Japan. If there are any material changes, we will notify you by posting an announcement on our Website or as required by applicable law. Your continued use of our Services after the updated Privacy Policy takes effect constitutes your acceptance of the terms.

2. How We Collect, Use, and Share Information

To provide you with VESTA JAPAN’s monthly rental marketplace platform, we must collect and process your Personal Information. Some of this information is collected directly from you, while other parts are obtained through automated technologies or trusted third-party services (such as identity verification partners or payment processors).

  • If you are a Tenant: You may provide us, our Landlords, or our Service Providers with Personal Information such as identifiers (name, email, phone number, passport number, or emergency contacts); employment details; financial information (such as income details, bank accounts, or billing information via payment gateways); and rental preferences. We primarily use this information to connect you to Landlords, facilitate your short-term/monthly rental applications, process payments securely, verify your identity, and improve the functionality of our website.

  • If you are a Landlord: You may provide us or our Service Providers with Personal Information such as your name, corporate / business entity details, contact information, banking details for receiving rental payments, and property details. We use this information to list your properties, connect you with qualified Tenants, process transactions, and maintain account security. Information provided to you regarding a Tenant may only be used for the direct purpose of evaluating or executing the rental agreement with that Tenant.

Important Notice on Data Selling / Sharing

VESTA JAPAN DOES NOT SELL YOUR PERSONAL INFORMATION TO THIRD PARTIES FOR CASH OR COMMERCIAL GAIN.

We do not license or sell your sensitive data or rental history to third-party data brokers. We share your information with third parties only to the extent necessary to fulfill our core services (such as processing payments via Stripe, verifying identities, or passing application profiles to the Landlord you choose to contact) or for platform analytics as detailed below.

Other Reasons We May Use or Disclose Your Information

  • Payment Processing: We utilize Stripe Connect to handle marketplace financial flows. Your credit card information is encrypted and transmitted directly to Stripe; VESTA JAPAN does not store raw credit card numbers on our local servers. Stripe processes this data in accordance with its own privacy policy.

  • External Data Transmission (Telecommunications Business Act & APPI Compliance): To operate and improve our Services, basic device data is transmitted to external providers. In compliance with the Telecommunications Business Act of Japan and for full transparency under the APPI regarding third-party delegation, we disclose the following:

    • Essential Infrastructure & Processing: For the essential operation of our platform, database management, and secure payment handling, basic connection data (such as IP addresses) is transmitted to Webflow (Frontend Hosting), Xano (Backend Database), and Stripe (Payment Processing).

    • Analytics (Google Analytics): We transmit IP address, device information, and browsing history to Google LLC to analyze traffic demographics and optimize the user interface. You can opt out of Google Analytics tracking by using the Google Analytics Opt-out Browser Add-on.

  • Legal and Administrative Safety: We may preserve or disclose your information to law enforcement or government authorities in Japan if we believe in good faith that such disclosure is legally required to comply with court orders, subpoenas, the APPI framework, or to protect the safety, rights, and property of VESTA JAPAN, our users, or the public.

  • Corporate Restructuring: In the event of a merger, acquisition, business transfer, or asset sale, your personal information may be transferred to the acquiring entity as part of standard business continuity, subject to appropriate privacy safeguards.

3. User Privacy Choices and Rights

Regardless of your nationality, VESTA JAPAN values your control over your own data. We provide the following options to manage your privacy choices:

  • Email Communications: You can unsubscribe from our marketing or transactional notification emails at any time by clicking the “unsubscribe” link at the bottom of the email. Critical operational emails (e.g., lease updates, payment confirmations, security alerts) do not have an opt-out option.

  • Cookies: You can modify your browser settings to decline cookies. Please note that blocking all cookies may prevent certain interactive elements of our monthly rental booking engine from operating correctly.

  • Access, Correction, and Deletion Rights: Under the Japanese APPI, you have the right to confirm whether we process your data, request a copy of your personal data in our possession, request updates or corrections to inaccurate information, or request the permanent deletion of your account and personal history.

We will verify your identity (typically by verifying your registered email or passport record) before processing requests to protect against unauthorized data exposure.

4. Data Retention and International Data Transfers

We retain your Personal Information for as long as your account remains active, or as necessary to fulfill the operational requirements of your monthly rental agreements, settle payment disputes, enforce our Terms of Service, and comply with Japanese corporate and tax law retention mandates.

International Transfers: VESTA JAPAN operates its web architecture using localized cloud solutions (including Webflow, Stripe, and Xano). Your data may be transferred to, stored in, or processed in cloud data centers located outside of Japan.

  • Data Protection Measures: While the destination country may have different privacy regulations than Japan, we ensure that our infrastructure partners adhere to strict, internationally recognized security standards (such as SOC 2 and ISO 27001).

By using our Services, you consent to the cross-border transfer of your information to these secure infrastructure providers under the APPI framework.

5. Protection of Minors

Our monthly rental platform and properties are intended for users who are at least 18 years of age (or the legal age of majority required to independently sign a residential rental agreement). We do not knowingly collect or maintain data from individuals under 18. If we discover that a minor has provided us with personal information without parental or guardian consent, we will take immediate steps to delete that information from our active databases.

Our Website contains links to external web properties, landlord-specific websites, or external map systems. VESTA JAPAN does not control and is not responsible for the privacy practices, code accuracy, or content layout of third-party platforms.
